This was a great not guilty finding on a DUI charge in Cook County after a bench trial. This client was arrested for driving the wrong way on a four lane road for more than one mile at approximately 2:00 a.m. The client failed his field sobriety tests and has a strong odor of alcohol on his breath. But as our client was from another country and driving the wrong way on the road, the officer testified that in some foreign countries people do drive on that side. When asked, the officer testified that other than the wrong direction of travel, everything else about the clients driving was acceptable. Further, when the client was removed from the purview of the video recording device in the squad car, the field sobriety tests were discounted.
